  • Violates any applicable law, regulation, or third-party rights.

  • Involves sharing false or misleading information.

  • Attempts to hack, disrupt, or interfere with the App’s operation or security.

  • Resells or commercialises any part of the App without written consent from Swirl.

5. Wine Recommendations

• Recommendations: Swirl provides wine recommendations based on personal taste preferences. However, these recommendations are for informational purposes and are not a guarantee of specific wine quality or compatibility.

6. Subscription Services

• Some features in the App may require a subscription. Subscription fees are billed in advance, and by signing up, you agree to the terms of payment.

• You may cancel your subscription at any time, but refunds are not provided for any unused portion of the subscription period.

7. Intellectual Property

• Swirl and its content, features, and functionality are the exclusive property of Swirl and its licensors.

• You agree not to copy, distribute, modify, or create derivative works based on the App or any of its content without express written permission.

8. Third-Party Links and Content

• The App may contain links to third-party websites, products, or services. Swirl does not endorse or assume responsibility for any third-party content, nor is Swirl liable for any transactions or interactions you may have with third parties through these links.

9. Disclaimers and Limitation of Liability

• No Warranty: Swirl provides the App on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

• Limitation of Liability: To the fullest extent permitted by law, Swirl and its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles arising from your use of the App.

10. Indemnification

You agree to indemnify and hold harmless Swirl and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of the App or violation of these Terms.

11. Termination

Swirl reserves the right to suspend or terminate your account at any time, with or without cause, if you violate these Terms or if your use of the App could potentially harm Swirl or other users.

12. Governing Law and Dispute Resolution

• These Terms shall be governed by the laws of Sweden.

• Any disputes arising out of or related to these Terms or the App shall be resolved through binding arbitration in Stockholm, and you waive any right to participate in a class action lawsuit.

13. Changes to Terms

Swirl may update these Terms periodically. If we make significant changes, we will notify you by email or through the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
